Notice is hereby given that Messinaservizi Bene Comune S.p.A., intends to proceed with the identification, in compliance with the principles of non-discrimination, equal treatment, proportionality and transparency, of economic operators to be invited to the procedure for the award of the services in question, where permitted by the regulations in force, without prejudice to and unchanged by the economic and contractual conditions set out in this notice, unless terminated by mutual consent of the parties, by means of a negotiated procedure, without a call for tenders, pursuant to Article 63 of Legislative Decree No. 50 of 2016, in application of Article 1 co.2 lett. b) of decree-law no. 76 of 16 July 2020, converted by law no. 120 of 11 September 2020 on: "Urgent measures for simplification and digital innovation", as amended by Decree-Law no. 77 of 31.05.2021, or direct awarding pursuant to art.1 co.2 lett. a) (by way of derogation from Art.36 co.2 of Legislative Decree no.50/2016) of Law Decree no.76/2020 (Simplification Decree), converted with amendments by Law no.120/2020, as amended by Art.51 co.1 lett. a) point 2.1 of Law Decree no.77/2021.
The market survey is not binding for the Contracting Authority, which reserves the right to suspend, modify or cancel, in whole or in part, the procedure initiated, without any claims on the part of the applicants.
